1. About us

This service ("Quit Coach", "the App") is operated by Dharmamurti Pty Ltd (ABN 17 689 319 622), an Australian proprietary limited company, trading as Quit Coach by ClearPath ("we", "us"). By using the App you enter into a binding agreement with Dharmamurti Pty Ltd.

2. Acceptance

By creating an account or continuing to use the App you confirm you are at least 18 years old, have authority to enter this agreement, and accept these Terms.

3. What Quit Coach provides

Quit Coach is a digital smoking-cessation program offering an evidence-informed quit plan, craving and trigger tools, savings tracking, community support, and (on the Pro plan) AI coaching. It is an educational and motivational service, not medical treatment. Quit Coach does not replace advice from your GP, pharmacist, Quitline (13 7848), or other healthcare professionals.

4. Medical disclaimer

If you are pregnant, taking medication, have a mental health condition, or use nicotine replacement or other cessation medication, consult your GP. If you are in crisis call Lifeline on 13 11 14 or 000 in an emergency.

5. Account and acceptable use

You must keep your credentials confidential and provide accurate information. You must not:

• Use the App unlawfully, fraudulently or to spam others.
• Post content that is abusive, defamatory, discriminatory or infringes others' rights.
• Reverse-engineer, scrape, probe security, or distribute malware.
• Resell or sublicense the service.
• Misuse the community by promoting smoking, vaping or other harmful products.

6. AI coach use

Pro plan AI features generate responses automatically and may be inaccurate or incomplete. Do not rely on AI output for medical, legal or financial advice. You are responsible for how you act on AI suggestions. Do not submit content you do not have the right to share.

7. Subscriptions and payment

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax and subscription mechanics are governed by Paddle's Buyer Terms.

Plans renew monthly until cancelled. Cancel anytime via the billing portal; cancellation takes effect at the end of the current period. The 4-day free trial requires a payment method and converts to a paid subscription unless cancelled before trial end.

9. Intellectual property

All software, content, branding and design in Quit Coach are owned by Dharmamurti Pty Ltd or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the App for your personal, non-commercial use during your subscription. Content you post grants us a worldwide, royalty-free licence to host and display it solely to operate the service.

10. Service availability

We aim for high availability but do not guarantee uninterrupted, error-free or secure operation. We may modify or discontinue features with reasonable notice.

11. Suspension and termination

We may suspend or terminate your account for material breach, non-payment, security/fraud risk or repeated policy violations. You may cancel at any time. On termination your access ends; you may request export or deletion of your data within 30 days (subject to legal retention).

12. Australian Consumer Law

Nothing in these Terms excludes consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). To the extent permitted by law, our liability for failure of a non-major consumer guarantee is limited to re-supplying the service or refunding the fees paid in the previous 12 months.

13. Liability

To the maximum extent permitted by law, we exclude liability for indirect, consequential, or special loss (including loss of profits, data or goodwill). Our aggregate liability is capped at the fees you paid us in the 12 months before the claim. We do not exclude liability for fraud, death or personal injury caused by our negligence.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have exclusive jurisdiction.
