Australia's vaping rules changed sharply in 2024 and remain in force in 2026. Here is what you can legally buy, where, and what happens if you do not.

Nicotine vapes are pharmacy-only

Since 1 October 2024, nicotine vapes can only be sold through pharmacies. Adults 18 and over can buy lower-strength products without a prescription in most states after speaking with the pharmacist.

Higher nicotine strengths, and anything outside standard pharmacy stock, still require a prescription from a GP or nurse practitioner.

What is illegal

Buying or selling flavoured disposable vapes from convenience stores, tobacconists, vape shops or online sellers.
Importing nicotine vaping products from overseas without a valid prescription.
Selling any vaping product to anyone under 18.
Advertising or promoting vaping products to consumers.

Packaging and flavours

Legal products come in plain pharmaceutical-style packaging, limited to mint, menthol and tobacco flavours. Bright disposables with dessert or fruit flavours are, by definition, illegal products.

Because illegal devices are unregulated, nicotine content is often far higher than labelled — a common reason people find them so hard to put down.

Penalties

Enforcement targets suppliers rather than users. Commercial import and sale offences carry fines into the millions and, in some states, imprisonment. Personal possession is generally not the focus.
